DS Elite Volleyball, LLC — SMS Program Terms & Conditions

1. Program description
The DS Elite Volleyball SMS program ("the Program") is operated by DS Elite Volleyball, LLC ("DS Elite Volleyball," "we," "us"). It sends program-related text messages to parents and legal guardians of athletes registered with our club: practice and tournament schedule changes, weather cancellations, tryout and event reminders, uniform and order updates, and replies to questions you send us. We do not send marketing, promotional, or third-party content through this Program.
2. How you consent
You consent to receive SMS messages from DS Elite Volleyball, LLC by checking the SMS consent checkbox on our text-updates form at www.dselitevolleyball.com/text-updates. Consent is given directly to DS Elite Volleyball, LLC for this Program only. It is not a condition of any purchase or of your athlete's participation in club activities; you may decline SMS and receive communications by email instead. Phone numbers provided on athlete registration forms are not used for this Program unless you also complete the text-updates form.
3. Message frequency
Message frequency varies. On average, expect 2–8 messages per month, with periodic increases around tryouts, tournaments, and season transitions.
4. Cost
Message and data rates may apply, charged by your mobile carrier. DS Elite Volleyball, LLC does not charge for SMS messages.
5. How to opt out
Reply STOP to any message to stop receiving texts. You will receive one confirmation message and no further texts. Reply START to resume.

7. Eligible recipients
The Program is intended for adult (18+) parents or legal guardians of athletes registered with DS Elite Volleyball, LLC. You represent that you are the account holder of the mobile number you provide, or have the account holder's permission to receive messages on it.
8. Your information
We do not sell, rent, or share your mobile number or opt-in information with third parties or affiliates for marketing or promotional purposes. How we handle your information is described in our SMS Privacy Policy at www.dselitevolleyball.com/sms-privacy.
9. Carrier disclaimer
Carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages. We make commercially reasonable efforts to deliver messages but cannot guarantee delivery in all cases.
10. Changes to the Program
We may modify, suspend, or discontinue the Program at any time. Material changes to these Terms will be posted on our website and, where appropriate, sent as a one-time SMS to active subscribers.
11. Limitation of liability
To the maximum extent allowed by law, DS Elite Volleyball, LLC is not liable for incidental, consequential, or special damages arising from your use of or inability to use the Program, including missed notifications. Your sole remedy for dissatisfaction with the Program is to opt out.
12. Governing law
These Terms are governed by the laws of the State of Texas. Disputes will be resolved in courts located in Travis or Hays County, Texas.
